This book was inspired by the need for a quick and ready reference for perfections costs and requirements of land transactions in the various States of Nigeria.
In the course of practice I have had clients call me for information regarding perfection in one State of Nigeria or the other, including the Federal Capital Territory, Abuja.
In some instances, having had experience with perfection in certain States, I was able to give a prompt response. In other cases, I was obliged to make enquiry myself into the procedures and or costs of perfection in States where I had no experience in perfection of land documents.
There is a need for uniform costs and procedures for perfection of land documents throughout the Federation. This is because interest in land throughout the Federation is basically guided by the Land Use Act. Also, certain interests in land covered by charges such as mortgages and debentures are required to be registered not only in the Lands Registry in the office where the interest is registered but also at the Corporate Affairs Commission, Abuja, a federal agency which applies the same requirements for registration no matter where the land is located.
More important, right to acquire interest in immovable property, the most common of which is land, is a constitutionally guaranteed right. Section 43 of the 1999 Constitution of the Federal Republic of Nigeria (as amended) provides that “subject to the provisions of this Constitution, every citizen of Nigeria shall have the right to acquire and own immovable property anywhere in Nigeria.”
